How long does trademark registration take in Thailand?
A Thai trademark application typically takes between 18 and 24 months from filing to registration, assuming the mark passes examination without objection and no opposition is filed during the publication period. Marks that face examination queries or opposition proceedings will take longer. Filing promptly is important because rights in Thailand are determined by registration date, not by first use — a mark unregistered while a third party registers the same or similar sign may be difficult or costly to recover.
What is the difference between an invention patent and a petty patent?
Thailand's Patent Act provides for two categories of patent protection for inventions. An invention patent requires that the invention be novel, involve an inventive step, and be capable of industrial application; it offers protection for up to 20 years. A petty patent (sometimes called a utility model) has a lower inventive step threshold, is faster to obtain, and offers protection for up to 10 years — making it well suited to incremental improvements and products with shorter commercial cycles. We advise on which route best fits your invention and commercial timeline.
Does copyright need to be registered in Thailand?
Copyright in Thailand arises automatically upon creation of an original work — registration is not required for the right to exist. However, voluntary notification with the Department of Intellectual Property creates a dated public record of ownership, which can be valuable evidence in the event of an infringement dispute. We advise on when notification is worth pursuing and on structuring ownership arrangements — particularly for works created by employees, contractors, or joint teams — to ensure that the rights sit where the client expects them to.
Can I use the Madrid System to register my trademark in Thailand and other countries at once?
Yes. Thailand is a member of the Madrid Protocol, which allows an applicant who has a home-country application or registration to file a single international application through WIPO designating any number of member countries, including Thailand. This simplifies multi-country filing significantly. If you are a Thai-based applicant seeking protection abroad, or a foreign applicant seeking Thai protection alongside other markets, we can advise on whether the Madrid route or direct national filing is more appropriate for your portfolio and commercial footprint.
How do I protect confidential business information that cannot be patented?
Trade secret protection under the Thai Trade Secrets Act B.E. 2545 applies to commercially valuable information that is kept confidential and that the holder has taken reasonable steps to protect. This covers formulas, processes, client lists, manufacturing methods, and similar information that would lose its value if disclosed. The protection does not require registration but depends entirely on the measures taken — confidentiality agreements, access controls, and internal policies. Our advisory covers the contractual and procedural framework needed to establish and maintain trade secret status in a way that would be defensible in enforcement proceedings.
