Challenge
A Bangkok food and beverage brand wanted to expand its trademark coverage to include a new product line but had already received a pre-registration opposition notice from a third party with a similar mark in an adjacent class.
Solution
We reviewed the similarity between the marks, the goods and services in the relevant classes, and the basis of the opposition. We drafted a detailed co-existence agreement that resolved the opposition without litigation and allowed both applications to proceed.
Result
Opposition resolved within 6 weeks. Both applications registered. Client saved an estimated ฿120,000 in litigation costs. The co-existence agreement has since been used as a template for two subsequent market entries in Southeast Asia.
Challenge
A Chiang Mai product manufacturer had developed a novel packaging mechanism and wanted to understand whether a patent was worth pursuing, or whether trade secret protection was a more practical option given the product's expected market life.
Solution
We conducted a patentability assessment and confirmed the mechanism met the petty patent threshold. We then provided a comparison of the two approaches — patent versus trade secret — with a cost-benefit analysis tied to the product's realistic commercial timeline.
Result
Client chose the petty patent route. Application filed with a third party technical agent coordinated by Pranakorn. Petty patent granted 14 months later. Client used the grant to successfully negotiate a manufacturing licence with a regional distributor.
Challenge
A Bangkok technology company needed to establish clear copyright ownership of software developed in part by freelance contractors over several years, ahead of a due diligence process for an investment round.
Solution
We reviewed the relevant contractor agreements and assessed which works were likely to vest in the company under Thai copyright law and which required assignment. We drafted a form assignment agreement and a remediation checklist for the team to work through with each affected contractor.
Result
All required assignments obtained within 3 weeks. The due diligence process completed without IP-related issues. The client now uses the standard contractor agreement template we provided for all new engagements.
